This Hotel Accommodation Sales Agreement aims to provide the BUYER (defined below) with all necessary information regarding the rights and obligations of the parties concerning the hotel accommodation purchased from the SELLER, to ensure that the BUYER acquires all relevant information about the purchased product, and to confirm that the BUYER purchases the service knowingly and voluntarily.

 

1. PARTIES

The details of the purchased accommodation have been fully explained to the BUYER at the sales office. All information has been provided and the BUYER has evaluated and purchased the service accordingly.

 

2. SALES PRICE

2.1 The price of the product/service purchased by the BUYER is TL.

2.2 The type, duration, and price of the product/service purchased by the BUYER are specified in this Hotel Accommodation Sales Agreement. The prices listed in this Agreement and on the Vesentur website include all taxes. Prices and commitments listed on the Vesentur website remain valid until updated or changed. Time-limited prices and commitments are valid until the specified period ends.

2.3 This Agreement will be deemed concluded only upon full payment of the accommodation fee by Vesentur and will only take effect once the full payment is received by Vesentur.

 

3. INFORMATION REGARDING PAYMENTS MADE BY CREDIT CARD

3.1 Vesentur does not offer installment sales within its own system.

3.2 The prices provided to participants are cash prices, and any installment arrangements are made through banks’ credit cards at the participant’s request, without any interest or fees added by Vesentur. All transactions made by credit card occur solely between the cardholder and their bank; Vesentur has no responsibility or right to intervene.

3.3 Participants who purchase services via credit card must notify the bank for early payment, installment reduction, or similar requests and follow the bank’s payment procedures.

3.4 If participants cancel a service purchased via credit card, and Vesentur approves the refund, Vesentur will refund the amount to the participant’s credit card. Vesentur’s responsibility is limited to this. All further actions are between the bank and the participant. For installment payments, the bank’s rules apply, including for refunds made in installments.

3.5 Credit card purchases are subject to the bank’s current campaigns, cancellation, and refund conditions.

 

4. CANCELLATION AND REFUND CONDITIONS & SERVICES NOT ELIGIBLE FOR RIGHT OF WITHDRAWAL

4.1 For requests regarding cancellations and refunds under this Agreement, the hotel’s policies attached to this Agreement and listed below will apply.

4.2 Vesentur acts as an intermediary between the service provider and the BUYER. Due to the nature of services sold by the TOUR OPERATOR, the BUYER has no right of withdrawal under Article 15/1(g) of the Distance Contracts Regulation. Full payment is collected from the BUYER, who acknowledges and accepts this.

4.3 Reservations purchased for early booking, special periods (New Year, semester break, holidays, etc.), or promotional periods cannot be canceled. The BUYER has purchased the service with full knowledge and acceptance of this condition.

4.4 For non-early booking, non-special period, or non-promotional products, cancellation requests can be made after consultation and approval by the service provider. If the service provider does not approve, no refund will be made.

4.5 Reservations purchased under “Non-refundable” conditions cannot be canceled, changed, or refunded.

4.6 Situations that were not anticipated at the time of signing, beyond the parties’ control, and prevent partial or full fulfillment of obligations under this Agreement (force majeure: natural disasters, war, terrorism, riots, changes in legislation, confiscation or strikes, lockouts, significant disruptions in production or communication facilities, etc.) will be considered force majeure. If force majeure prevents performance, the affected party must immediately notify the other party in writing. If the BUYER requests contract termination due to force majeure, the SELLER or PROVIDER will make all reasonable efforts to refund the amount. The SELLER or PROVIDER is obliged to refund the amount received from the person or organization from whom the service was purchased; they are not responsible for amounts they cannot recover.

 

5. PRE-CONTRACT INFORMATION

5.1 Under Article 5 of the Distance Contracts Regulation, the BUYER can complete the purchase of services on the www.vesentur.com website only after approving the pre-contract information form containing all details regarding the selected service (dates, price, product, concept, etc.). Records of these electronic approvals are maintained. In phone sales through the Call Center, these details are communicated verbally before payment, and verbal consent is recorded and stored in the Call Center system.

5.2 The SELLER or PROVIDER is obliged to inform the BUYER of any possible cancellations as soon as possible.

5.3 The BUYER has read and approved this Agreement and the Pre-Contract Information Form on behalf of themselves and other participants. The BUYER is jointly and severally responsible for payment of the contract price. The BUYER acknowledges that they are responsible for providing information to other participants, and all pre-contract information provided to the BUYER is deemed provided to the participants.

5.4 If the purchased service is defective, the BUYER must immediately notify the SELLER or PROVIDER and the accommodation facility in writing with evidence. Otherwise, the service is considered accepted, and no refund will be made.

5.5 Situations beyond the control of the parties that prevent fulfillment of obligations (force majeure) will be treated as in clause 4.6 above. The SELLER or PROVIDER will make all efforts to refund the amount if the BUYER requests termination due to force majeure.

5.6 The seller or provider must perform their obligations within the agreed timeframe. If they fail, the consumer may terminate the contract. In such a case, the seller or provider must refund all payments, including legal interest according to Law No. 3095, within 14 days of receiving the termination notice, and return any valuable documents provided by the consumer.

5.7 If performance becomes impossible, the seller or provider must notify the consumer in writing or via a durable medium within three days and refund all payments within 14 days of the notification.

5.8 Any additional fees outside the agreed contract price require the consumer’s explicit consent before the contract is concluded.

5.9 Turkish citizens can enter the TRNC with a T.C. ID Card. Entry with a passport may cause issues for later travel to Greece; using a T.C. ID Card is recommended.

 

6. INFORMATION REGARDING ACCOMMODATION TERMS

6.1 Invoices are sent to the address specified by the BUYER in the invoice address section at the time of reservation. If the invoice address section is left blank, the invoice is sent to the communication information address. Vesentur is not responsible for undelivered invoices due to incorrect address, failure to specify the recipient, or the recipient not being present at the given address.

6.2 Child discounts are valid only when children stay in the same room as their parents. For reservations with children, the age declared by the BUYER will be taken into account. However, if there is a discrepancy between the child’s age as stated in the child's ID during hotel check-in and the age declared at the time of booking, the price difference will be paid by the BUYER to the facility or Vesentur, and the necessary adjustment will be made.

6.3 The BUYER must report any complaints in writing to the Vesentur representative during the service. If the BUYER leaves the facility without giving written notice claiming defective service, the use of the service will be considered accepted by the BUYER.

6.4 Additionally, if the BUYER leaves the facility due to defective service, they must inform the Vesentur representative and the hotel in writing on the day they leave, stating the reasons. Otherwise, leaving the facility will not be recognized, and the service will be considered used.

6.5 BUYER(s) acknowledge that room check-in may only be possible from 14:00 at the earliest, regardless of arrival time, and rooms must be vacated by 12:00 on the day of departure, regardless of check-out time. Any extra food, beverages, or off-system services at the facility are the responsibility of the BUYER.

6.6 Force majeure events, such as adverse weather conditions, road blockages, terrorism, strikes/lockouts, war threats, floods, fires, unpredictable technical issues, or issues caused by the accommodation facility, are considered force majeure. Vesentur may cancel or change the accommodation to another facility of the same category and type, either in the same or a different region. In such cases, the BUYER has no right to compensation.

6.7 Unsuitable weather conditions, lack of snowfall, etc., are not considered force majeure and do not justify cancellations. The BUYER is obliged to pay the full amount even if the accommodation is not used.

6.8 Minors traveling without both parents, with only one parent, or not sharing the same surname as their parent, must have a notarized consent letter issued by their official guardian/parent for the stay.

 

7. INFORMATION REGARDING THE HOTEL

7.1 The BUYER acknowledges and agrees that all information listed below has been provided at the time of purchase from the relevant hotel.

7.2 Room blocks are arranged by the hotel; Vesentur has no authority to intervene.

7.3 In standard room reservations, French bed or twin bed requests are communicated to the hotel, but availability is determined by hotel staff considering seasonal occupancy.

7.4 For triple occupancy, a sofa bed is provided.

7.5 No guarantee is given for baby cots for guests with children. Requests are noted to the hotel at the time of booking and fulfilled based on availability. Vesentur has no responsibility.

7.6 Hotel opening and closing dates are determined by hotel management. In case of early closure or delay, alternatives are at the hotel's discretion.

7.7 In case of cancellations or changes, Vesentur’s responsibility is limited to communicating the request to the hotel. Actions are taken according to the hotel’s approval.

7.8 Late check-in due to adverse weather or road conditions is subject to the hotel’s rules and approval.

7.9 During holidays, school breaks, fairs, congresses, New Year, or other special periods, hotels do not accept cancellations, and the full accommodation fee applies. No refund or compensation rights exist.

7.10 Hotel change requests are generally not accepted. If approved by Vesentur or the hotel, the hotel prices of that day will apply.

7.11 Vesentur cannot intervene in seasonal or hotel-initiated concept changes; these are at the hotel's discretion.

7.12 Paid and free activities offered at hotels are determined by hotel management. Vesentur has no authority over them.

7.13 Information or prices provided before booking may change. The information and prices at the time of reservation prevail.

7.14 Hotel check-in and check-out times depend entirely on hotel availability. Vesentur cannot guarantee these times.

7.15 The BUYER confirms that all relevant product information has been provided and agrees that other persons using the service are also registered under the same terms.

7.16 Vesentur will send announcements, advertisements, emails, SMS, or catalogs to the BUYER in accordance with the “Electronic Commerce Law.” The BUYER may opt out of such communications by notifying Vesentur via [email protected].

7.17 Vesentur is not responsible for the hotel’s practices regarding guest acceptance, restrictions, or other operational decisions that differ from information provided by the BUYER. These requests should be directed to the hotel.

 

8. JURISDICTION
All disputes arising from this agreement shall be resolved by Consumer Courts, Consumer Arbitration Committees, or other authorized institutions within Turkey. Complaints can be submitted to the relevant Consumer Arbitration Committee or Consumer Court in accordance with annual monetary limits set by the Ministry.


Additional Clause 1 – Vesentur is not responsible for compliance of the accommodation facility with health measures announced by ministries, governorships, local directorates, or other administrative units, including changes made without prior notice. Such changes do not constitute non-performance or service defects by Vesentur.

Additional Clause 2 – Cancellation Guarantee Package (İGP) Information

  1. Applicable for domestic hotel stays of 1-14 nights between 31/10/2024–31/10/2025, with reservations made at least 5 days before check-in.
  2. Consumers who purchase İGP can cancel their reservation without deduction up to 72 hours before check-in.
  3. İGP does not cover date or name changes.
  4. İGP must be purchased within 5 days of booking; not available after day 6.
  5. İGP fees are non-refundable.
  6. Flight tickets included with hotel reservations are not covered. İGP fees are calculated based on accommodation and other services, excluding transportation.
  7. Applies only to select domestic hotels and campaigns for 2024-2025.
  8. Does not cover international stays.
  9. İGP fee is 1% of the domestic hotel reservation cost.
  10. Epidemic-related cancellations are covered.
  11. Each hotel’s cancellation policy varies. İGP grants 72-hour cancellation rights for applicable reservations.
  12. The following are excluded from İGP:
    a. Cancellations with less than 72 hours before check-in;
    b. Unpaid reservations before 72 hours prior;
    c. Transportation and transfer fees;
    d. Changes in reservation and resulting differences;
    e. Reservations exceeding 14 nights;
    f. Reservations made less than 5 days prior;
    g. Natural disasters, wars, terrorism, nuclear/biological/chemical risks, political risks, or strikes.

 

Additional Clause 3 – Thermal and Nature Hotels Campaign Terms

  • Valid for select reservations and stays from 23 September 2024.
  • Only valid for select domestic hotels. Payment terms vary by product group.
  • Only credit card payments accepted; cannot be combined with other campaigns.
  • Not valid for extra services (visa, flight, transfer, museum tickets, etc.).
  • Reservation guarantees secured via Masterpass with prepayment percentages as defined.
  • %25 Prepaid Thermal Hotels: 25% charged at booking, balance blocked 15 days prior, collected 5 days prior.
  • %25 Prepaid Nearby/Nature Hotels: same as above.
  • Non-prepaid domestic hotels: full amount blocked 5 days before, collected 3 days before.
  • Masterpass bookings can be canceled without reason up to 5 days in advance.
  • Cancellation outside these times follows hotel policies.

 

Additional Clause 4 – Ski Hotels Early Booking Campaign

  • Valid for select reservations and stays from 23 September 2024.
  • Campaign cannot be combined with other campaigns.
  • Extra services not included.
  • Masterpass %25 prepayment and non-prepaid options are not valid.

 

Additional Clause 5 – Summer Early Booking Campaign

  • Valid for select reservations from 23 October 2024 and stays between 1 April 2025 – 30 November 2025.
  • Only valid for select domestic hotels. Payment terms and discount rates vary.
  • Applies to all payment methods; non-prepaid hotels only via Masterpass.
  • Cannot be combined with other campaigns.
  • Reservation guarantee secured via Masterpass; balance collection and pre-authorization as defined.
  • %25 Prepaid Hotels: Booking 30 days prior, 25% charged at booking, balance pre-authorized 28 days prior, collected 5 days prior. Cancellation possible up to 25 days before.
  • Non-prepaid Hotels: Booking 10 days prior, pre-authorization 8 days prior, collected 72 hours before check-in. Cancellation possible at least 5 days in advance.
