Service Agreement

I. PAYMENTS
At the time of registration, at least 50% of the reservation fee must be paid, and the remaining balance must be paid no later than 21 days before the start of the trip. If the payments specified within the indicated periods are not made, the reservation will be canceled. In this case, 35% of the total trip cost will be invoiced to the consumer as a cancellation fee. ADEN GLOBAL CONSULTANCY AND TOURISM INC. undertakes and guarantees that it will not share credit card information with any third party under any circumstances.

 

II. CANCELLATION – WITHDRAWAL – CHANGES

Note: For programs including flights, cancellations cannot be made through the airline, and thus the reservation cannot be canceled or refunded.

  1. The travel agency may cancel the trip 3 days prior to departure if the minimum required number of participants is not met or due to force majeure. In such cases, the consumer has no right to compensation.
  2. a. If the consumer requests cancellation or changes up to 30 days before the trip starts, the full fee will be refunded. Except in cases where the consumer or their first-degree relatives provide an official report from a fully equipped government hospital documenting illness or death preventing their usual 10-day activities, if cancellation/change is requested 29–21 days before the trip, the consumer agrees and undertakes to pay 35% of the trip cost to ADEN GLOBAL CONSULTANCY AND TOURISM INC. If the request is made within 20 days of the trip, the consumer agrees to pay the full trip cost. Reservations that are postponed or changed cannot be canceled.

b. If the consumer wishes to cancel a discounted Early Booking product purchased during a discounted sales period for any reason, they agree and undertake to pay the full trip cost to ADEN GLOBAL CONSULTANCY AND TOURISM INC.

c. Guests who have purchased Early Booking Insurance have the right to cancel uninterrupted hotel reservations up to 72 hours before check-in. The insurance cannot be canceled, and premiums are non-refundable. Exceptions include war or warlike actions, revolutions, uprisings, internal disturbances, terrorism, epidemics, widespread diseases, earthquakes, floods, volcanic eruptions, landslides, and other natural disasters.

d. For guests and reservations without Early Booking Insurance, the cancellation/withdrawal/change terms outlined in section (b) apply.

e. If the consumer wishes to change the dates of a discounted Early Booking product purchased during a discounted sales period, the reservation change will be made at the list prices effective on the requested date without discount.

  1. If the consumer does not notify in writing that they will join a trip they missed at the start, the travel agency has the right to cancel all reservations made on behalf of the consumer after 24 hours. In such cases, no refund will be made.
  2. Force majeure includes adverse weather conditions, roadblocks, strikes, terrorism, war, the risk of war, unforeseeable technical issues preventing the start or continuation of the trip, and the illness or death of the consumer or their first-degree relatives preventing their usual 10-day activities.
  3. The travel agency may partially or fully cancel announced or registered tours up to 7 days before the trip. During the same period, it may change hotel names, means of transport, departure points, or the sequence of visits to sites in the itinerary. If the consumer does not accept these changes or cancellations, they may cancel their reservation and receive a full refund, without any right to additional compensation.

 

III. GENERAL PROVISIONS

  1. Consumers participating in the tour may bring 2 suitcases no larger than 50cm x 70cm, and in trips including flights, up to 15 kg of baggage. The responsibility for suitcases and their contents rests entirely with their owners.
  2. Items that are odorous, flowing, flammable, explosive, or disturbing to others, as well as sharp, piercing, or firearm weapons, and any animals, cannot be carried into vehicles or accommodations without explicit written permission from the Travel Agency, even if licensed.
  3. In case of loss or damage to the consumer’s baggage or belongings due to gross negligence of the travel agency staff, the agency will compensate half of the transportation portion of the total trip cost as material and moral compensation, regardless of the properties or value of the lost items. For items declared in writing by the consumer, the maximum liability of the travel agency is limited to the transportation portion of the trip.
  4. Visa procedures are not included in the purchased service. The travel agency has no obligation to obtain visas.
  5. Possible tour cancellation notices by the travel agency may be made individually to each consumer or generally through announcements in two high-circulation newspapers in Turkey.
  6. The travel agency is responsible for changes occurring after the start of the trip and may compensate the consumer either through refunds according to the TÜRSAB Istanbul Schedule or by providing additional or substitute services. Using these additional services does not nullify the consumer’s refund or compensation rights.
  7. If a consumer leaves a tour due to service defects, they must notify the agency representative and their hotel in writing with reasons; otherwise, the tour is considered used.
  8. Complaining about a tour while completing it does not cancel the consumer’s right to compensation for specific issues.
  9. By signing this agreement, the consumer confirms that they have read and accepted the terms and that the same conditions apply to other participants they registered.
  10. Consumers participating without signing the agreement are still bound by its terms and the signatory consumer may be held responsible for any excess payments.
  11. The travel agency acts as an intermediary between consumers and third parties (hotels, transport companies, service providers) and is not directly responsible for delays, defects, accidents, or natural events. The consumer must first claim from the primary responsible parties; the agency is liable only if the primary parties fail to pay.
  12. Matters not covered by this agreement are governed by Turkish Law, relevant statutes, international conventions, and the TÜRSAB Istanbul Schedule. Both parties accept the agreement in two copies, signed on both sides, acknowledging all terms, and the signatory accepts full legal responsibility on behalf of all consumers named in this agreement.

SERVICE COMPLAINTS: The TÜRSAB Arbitration Board is authorized for defective or inadequate services.

SERVICE GUARANTEE: The agency guarantees to deliver services as stated in advertisements and brochures, subject to sufficient participation and absence of force majeure. Refunds for partial or total failure to provide services will be determined according to the TÜRSAB Istanbul Schedule.
